Terms Of Service

WJ-Hosting provides web hosting to a large number of clients.  We have a responsibility to protect each client and provide the best services available. The following guidelines have been established to insure this intent is met.

Content: All services provided by WJ-Hosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or municipal law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secrets and other statutes. WJ-Hosting is not responsible for any claims resulting from the use of our service. 

Pornography and sex-related merchandising are prohibited on any WJ-Hosting account. This includes sites that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the internet.  Links to such materials are prohibited.

Background running programs: WJ-Hosting prohibits programs to run continually in the background.

IRC: We currently DO NOT allow IRC or IRC bots to be operated on our servers.  

Chat Scripts: Due to the nature of many of these scripts to overtax server resources, we only allow chat scripts included in our hosting packages to be run on our servers.

SPAM: The Customer may not use our service or server facilities to send out Unsolicited Commercial Email, or permit the mailing of UCE or SPAM emails to anyone, anywhere at anytime. There are no exceptions to this policy. We use several tools to track the source of each and every email sent from our servers. Rest assured, if you send SPAM, we will find out.  Spamming, or the sending of unsolicited email, from a WJ-Hosting server or using an email address that is maintained by WJ-Hosting is STRICTLY prohibited and will qualify your site for immediate deactivation with no refund. WJ-Hosting will be the sole arbiter as to what constitutes a violation of this provision. In addition, the customer may not advertise a web site hosted by the WJ-Hosting using UCE or SPAM from other networks. The Customer may not use SPAM or UCE to promote a domain hosted on our servers. Regardless of where the SPAM or UCE was sent from, it may not be used to direct the recipient to any domain name hosted on our servers. Users found to be using SPAM or UCE to promote a domain on our servers will have their accounts suspended or terminated at the sole discretion of WJ-Hosting.  

For our customers who have legitimate mailing lists and opt-in subscription services - we ask that you keep detailed records of user subscriptions. If we receive complaints about your mailings, you will need to provide proof that the receiving user has opted to receive your mailings.  If you cannot provide reasonable proof that the user requested the mailing, it will be considered SPAM.

Violations of this policy will result in immediate account suspension. Accounts will only be re-activated once the Company is satisfied that the Customer will no longer participate in SPAM or UCE.

Every violation of this policy after the first violation will result in an "Administrative Fee" of $475 for every SPAM or UCE email reported to abuse@wj-hosting.net. The customer will be held liable for this fee and will be pursued in court and/or by collection agencies if necessary to collect these Administrative Fees.

In addition, the Customer will be financially liable for any and all financial damages incurred by the WJ-Hosting as a direct or indirect result of SPAM or UCE.

In brief, Do not send SPAM or Unsolicited Commercial Email.

Server Abuse: Any attempts to undermine or cause harm to any WJ-Hosting account, server or customer of WJ-Hosting is strictly prohibited.  WJ-Hosting holds no responsibility for the use of our clients' accounts.  The customer may not use the WJ-Hostings's service or facilities to abuse common facilities on the internet. This includes willful proliferation of viruses, denial of service attacks, mail bombing, using a non-existent mail address, excessive cross posting in USENET, or any other activities that are malicious and abusive.

Billing: Payments are due one day prior to the account expiration date.  Past due accounts are subject to a 10% late fee, and will be deactivated until payment is made in full.  Accounts 10 days past due will be deleted from the server. If any terms or conditions are failed to be followed the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason  that WJ-Hosting sees fit.
